1. Who we are

Hardy Apex is a Canadian sole proprietorship operated by Pierre Hardy. We grade and sell collectible toy marbles through this website, justmarbles.online, and through our Etsy shop, JustMarblesVault.

2. What personal data we collect

We only collect the personal data needed to complete your order, communicate with you and meet legal obligations:

• Identity and contact details: name, Etsy username, email address, phone number if you give one
• Order information: items purchased, price, currency and transaction date
• Delivery information: shipping address, delivery confirmation and tracking number
• Payment information: we never receive or store full card details. Payments are handled by Shopify, Etsy Payments or PayPal under their own policies
• Communications: messages you send us by email, through Etsy Conversations, or through the Swirlie chat assistant
• Account data: if you create a collector account, your profile, favourites and saved chat sessions
• Tax and accounting records: invoices, refunds and transaction history

3. How and why we use your data

We rely on these legal bases: performance of a contract (fulfilling and shipping your order), legal obligation (tax and accounting records), and legitimate interest (customer support, fraud prevention, improving our service).

We do not send marketing emails or newsletters unless you have explicitly opted in, and every opt-in email carries an unsubscribe link.

4. Who we share your data with

We share only what is necessary, with: Shopify and Etsy (order processing and checkout), payment processors, postal and courier services for delivery, our email delivery provider for order and account notifications, and our accountant or tax authorities where the law requires it.

We never sell your personal data, and we never share it for third-party advertising.

5. International transfers

We operate from Canada. If you are in the EU, EEA or UK, your data is transferred outside your region. Canada holds a partial EU adequacy decision, and our processors rely on Standard Contractual Clauses or equivalent safeguards.

6. How long we keep your data

Order and tax records are kept for six years, as required by Canadian tax law. Messages and support conversations are kept for up to two years. Collector account data is kept until you ask us to delete the account.

7. Your rights

Under GDPR, UK GDPR and PIPEDA you can request access to your data, correction, erasure, restriction of processing, portability, or object to processing based on legitimate interest. You can also withdraw consent at any time.

Email info@hardyapex.com and we will respond within 30 days, free of charge. If you are unhappy with our response you may complain to your local data protection authority, or to the Office of the Privacy Commissioner of Canada.

8. Cookies and analytics

This website uses cookies that are strictly necessary for the shop, cart and your login session, plus optional preference cookies for language and currency. You are asked about non-essential cookies on your first visit and can change your mind at any time. Etsy and Shopify set their own cookies on their platforms, governed by their own policies.

9. Security

Data is transmitted over encrypted connections and stored with access controls on managed, reputable platforms. No system is perfect, but we will notify you and the relevant authority within 72 hours of becoming aware of a breach that affects your rights.

10. Children

Our products are collectibles for adult collectors. We do not knowingly collect data from anyone under 16.

11. Changes to this policy

If we change this policy we update the effective date at the top of this page. Material changes affecting existing customers will be communicated by email.
